Welcome to Better Day Today. By accessing or using the Better Day Today mobile application and related services (collectively referred to as the “Service”), you agree to these Terms and Conditions.
If you do not agree with these Terms, you should not use the Service
1. Purpose of the Service
Better Day Today provides educational tools designed to support emotional awareness, self-reflection, and personal growth. The Service includes cognitive behavioral therapy (CBT)-inspired exercises, journaling prompts, reflective tools, and guidance intended to help users manage everyday thoughts, stress, and emotional patterns. The Service is designed for self-help and educational purposes only.
2. Not Medical or Mental Health Treatment
Better Day Today is not a medical provider, therapist, psychologist, psychiatrist, or licensed mental health provider. The Service does not provide therapy, mental health treatment, diagnosis, or medical care. Nothing provided through the Service should be interpreted as:

Use of the Service does not create a therapist-patient, psychologist-patient, or doctor-patient relationship.

3. Eligibility
The Service is intended for users located in the United States and be 18 years of age or older to use the Service. The Service is not directed to children. By using the Service, you confirm that:

4. Personal Responsibility
Users are responsible for how they use the information and tools provided through the Service. Better Day Today does not guarantee emotional outcomes or psychological improvements. Users should use their own judgment in deciding how to apply the exercises and suggestions provided by the Service. Better Day Today does not guarantee any specific emotional, psychological, or personal outcomes. Your use of the Service is voluntary and at your own risk.
5. Emergency Situations
Better Day Today is not designed to respond to emergencies or crisis situations. If you are experiencing severe distress, suicidal thoughts, or a mental health emergency, you should immediately contact emergency services or a crisis hotline. CALL OR TEXT 988 FOR THE SUICIDE AND CRISIS LIFELINE. The Service cannot monitor or intervene in emergency situations.
6. Artificial Intelligence
Some features of Better Day Today may use automated systems or artificial intelligence to generate responses, reflections, or exercises. AI-generated responses are based on programmed systems and may not always be accurate, complete, or appropriate for every situation. Users should not rely on AIgenerated responses as professional advice.
7. User Accounts
Users may need to create an account to access certain features. You agree to:

notify us if unauthorized access occurs
You are responsible for activity that occurs under your account.
8. Payments
Access to certain features of the Service may require the purchase of usage‑based tokens (“Tokens”). Users may purchase Tokens at a fixed price, as displayed at the time of purchase. Tokens are consumed based on use of applicable features of the Service. Token purchases are one‑time transactions and do not automatically renew. Tokens have no cash value, are non‑transferable, and are non‑refundable except as required by applicable law. Prices, Token amounts, and usage rates may change from time to time, and any such changes will apply prospectively. Payment processing for Token purchases made through the Apple App Store or GooglePlay is subject to the applicable app store’s billing terms and policies.
9. Intellectual Property
Ownership of the Service
The Service, including all software, code, algorithms, models, designs, text, graphics, interfaces, prompts, exercises, workflows, audio, video, trademarks, logos, and other content made available by Better Day Today (collectively, the “Company Content”), is owned by or licensed to Better Day Today and is protected by U.S. and international intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights, title, or interest in or to the Service or Company Content are transferred to you.
Limited License to Users
Subject to your compliance with these Terms, Better Day Today grants you a limited, non‑exclusive, non‑transferable, non‑sublicensable, revocable license to access and use the Service and Company Content solely for your personal, non‑commercial use.
You may not copy, reproduce, modify, distribute, display, perform, create derivative works from, reverse engineer, or exploit any portion of the Service or Company Content except as expressly permitted by these Terms or with prior written consent.
User Content
As between you and Better Day Today, you retain ownership of content you submit through the Service, including journal entries, responses, and reflections (“User Content”).
By submitting User Content, you grant Better Day Today a non‑exclusive, worldwide, royalty‑free, fully paid‑up license to host, store, process, analyze, reproduce, display, and otherwise use such User Content solely as necessary to operate, maintain, secure, improve, and provide the Service, including through automated and AI‑assisted systems, consistent with the Privacy Policy.
You represent that you have all rights necessary to grant this license and that your User Content does not infringe or violate any third‑party rights.
AI ‑ Generated Content
Any content generated by the Service through automated or artificial intelligence features (“AI Output”) is provided as part of the Service. To the extent permitted by law, Better Day Today retains all intellectual property rights in the underlying systems, models, and methodologies used to generate AI Output. You may use AI Output only in accordance with these Terms and solely for your personal use of the Service.
Feedback
If you submit comments, suggestions, ideas, or feedback regarding the Service (“Feedback”), you grant Better Day Today a perpetual, irrevocable, worldwide, royalty‑free license to use, modify, incorporate, and exploit such Feedback for any purpose without compensation or attribution.
Trademarks
All Better Day Today names, logos, slogans, and related marks are trademarks or service marks of Better Day Today. You may not use them without prior written permission.
Reservation of Rights
All rights not expressly granted are reserved by Better Day Today.
10. Third Party Services
The Services may rely on third party platforms (including hosting, analytics and payment processing). Better Day Today is not responsible for third party service providers or their terms and conditions or privacy practices.
11. Disclaimers
The Services Provided “As Is” And “As Available.” Better Day Today Disclaims All Warranties, Expressed Or Implied, Including Implied Warranties And Merchantability, Fitness For Particular Purpose Or Non- Infringement.

13. Indemnification
You Agree To Indemnify And Hold Harmless Better Day Today From Any Claims Arising Out Of Your Use Of
The Service Or Violation Of The Terms.
14. Termination
Better Day Today May Suspend Or Terminate Access At Any Time For Violation Of These Terms Or To Protect
The Service.
15. Dispute Resolution; Action; Class-action Waiver
Any Dispute, Claim Or Controversy Arising Out Or Related To The Services Or These Terms (Collectively,
“Dispute”) Shall Be Resolved By Final And Binding Arbitration Rather Than In Court. You Hereby
Expressly Waive The Rights To A Jury Trial. The Arbitration Shall Be Administered By The American

Day Today Does Not Guarantee That The Service Will Be Uninterrupted, Secure, Or Error-free, And May
Modify, Suspend, Or Discontinue The Service At Any Time.
17. Governing Law
These Terms Shall Be Governed By, And Construed In Accordance, The Laws Of The State Of Delaware.
18. Miscellaneous
These Terms, Together With A Privacy Policy, Constitute The Entire Agreement Between You And Better Day
Today. If Any Provision Is Unenforceable, The Reminder Remains In Effect. No Waiver Is Implied By Failure To
Enforce Any Provision Of These Terms Or Of The Privacy Policy. You May Not Assign Your Rights Under The
Terms Without Better Day Today’s Prior Written Consent.
